Coinbase Tokenized Stocks Are Live Before the Senate Votes

Ryan VanGrack is pushing a Sept. 15 CLARITY Act vote, but Coinbase already issues tokenized US stocks from Abu Dhabi for non-US DeFi users.

Coinbase Vice Chair Ryan VanGrack said on September 8 that onchain finance and tokenization are already here, six days before a Senate cloture vote on the CLARITY Act. He was speaking with Scarlet Fu and Tim Stenovec, then posted the same case to X: capital follows clear rules, and the open question is where the market lives, not whether it exists.

That line treats the September 15 vote as a location fight. Coinbase has already issued the product from Abu Dhabi, listed it on Base for users outside the United States, and plugged it into lending apps. The Senate is not switching the lights on.

What the Senate Votes on Sept. 15

At 2:15 p.m. ET on September 15, the Senate votes on cloture on the motion to proceed to H.R. 3633, the Digital Asset Market Clarity Act, not on final passage. Sixty senators must agree to begin debate. A yes does not send a law to the president; a no stops the bill before the first amendment.

The H.R. 3633 bill record still shows Passed House. Rep. J. French Hill of Arkansas introduced the measure on May 29, 2025, and the House approved it 294-134 on July 17, 2025. The Senate Banking Committee moved its version 15-9 on May 14, 2026, with Democrats Ruben Gallego and Angela Alsobrooks joining all 13 Republicans, then placed it on the legislative calendar on June 1 as Calendar No. 423.

Majority Leader John Thune presented the August 8 cloture motion on the motion to proceed before the recess. The chamber is due back at 3 p.m. on September 14, which leaves one night of session before the procedural clock rings.

HOW THE BILL GOT TO CLOTURE

  1. May 29, 2025: Rep. J. French Hill introduces the Digital Asset Market Clarity Act.
  2. July 17, 2025: The House passes the bill 294-134.
  3. May 14, 2026: Senate Banking advances it 15-9.
  4. June 1, 2026: The bill is placed on the Senate calendar as Calendar No. 423.

  6. September 15, 2026: Cloture ripens at 2:15 p.m. ET.

The CRS summary on the bill page assigns digital commodities to the CFTC, keeps the SEC on broker-dealer and exchange activity that still looks like securities work, and puts exchanges, brokers, and dealers under Bank Secrecy Act rules. That split is the policy Coinbase wants written into US law. It is not the license under which the company’s tokenized stocks already trade.

Coinbase Already Issued the Stocks From Abu Dhabi

Base said on August 24 that tokenized stocks live on Base as B20 tokens, each matched 1:1 to a share held by a regulated custodian. Authorized participants buy the stock. Alpaca Securities, an SEC-registered broker-dealer, holds it in a bankruptcy-remote account. Coinbase Onchain SPV Ltd, incorporated in the Abu Dhabi Global Market, issues the token. Holders get a beneficial claim on the share, not a synthetic IOU, and dividends are tracked with an onchain multiplier so DeFi balances do not break on a split or a payout.

The Financial Services Regulatory Authority approved the NVIDIA prospectus on August 4. The offer is made in ADGM to authorized participants under Regulation S. Base’s own listing page states the tokens are available only in eligible jurisdictions outside the US, which is why VanGrack’s “bring innovation onshore” line is a rulebook argument, not a description of who can buy NVDAc from a US wallet this month.

US persons stay locked out while Washington still has a tokenization exemption on hold, so the live book had to sit under ADGM rules. Base added six more names on September 4, taking the public registry to 10 tokenized stocks.

SpaceX is the private-company name in that set. Tokenholders are not written onto the issuer’s shareholder register; the SPV holds legal title and the token carries the economic claim. That is the structure VanGrack is asking the Senate to compete with, not a product waiting on cloture.

Those Tokens Already Work as DeFi Collateral

Chainlink, in an August 24 release, said Coinbase picked it as the official oracle for the stocks and that its data feeds let lending markets, DEX venues, and structured-product apps treat the tokens as tokenized equities as collateral. The same release put the wider tokenized-equity category at $2.3 billion by mid-July 2026. NVDAc, METAc, AAPLc, and GOOGLc were the first feeds; more names followed as the registry grew.

Base lists Aave for lending against the positions, Morpho and Euler for extra borrow markets, and Aerodrome for spot liquidity, with 0x, 1inch, KyberSwap, and CoW Swap on routing. Chainlink’s own docs price each B20 token as the underlying equity market price times the onchain multiplier, using 24/5 equity prints even though the tokens can trade all week. That is a working collateral stack for non-US wallets. It does not become more real if 60 senators vote yes.

The 60-Vote Math Still Does Not Close

Cloture needs 60 votes. Republicans hold 53 seats, with 45 Democrats and two independents, so a clean GOP roll still needs seven more votes. Only Gallego and Alsobrooks crossed at committee, and both tied that yes to more talks before a floor commitment. Sens. Rand Paul and Josh Hawley have been counted as likely Republican nos on this family of bills, which would push the Democratic ask higher than seven.

WHAT STILL BLOCKS CLOTURE

  • The threshold: Sixty votes are required even to start debate, and 53 Republican seats do not get there alone.
  • Committee Democrats: Only two Democrats voted the bill out of Banking, and both said the floor text still had to move.
  • Ethics language: Senate Democrats have demanded rules on officials who hold or sponsor digital assets, and they rejected a July 22 draft that left enforcement with the Justice Department and sunsets on January 20, 2029.
  • Section 604: DeFi developer and non-custodial safe-harbor text is still the illicit-finance fight inside the bill.
  • The calendar: Even a yes on September 15 still needs amendments, a second cloture, and a House vote on whatever Senate text survives before the November 3 midterms.

Whip counts on X keep treating the vote as a binary for “crypto in America.” The louder problem in the replies is the ethics clause and the stablecoin-yield fight, which is a Coinbase revenue issue as much as a market-structure issue. Sheriffs were the public talking point through the summer. They are not the remaining math.

Sheriffs Dropped Their Fight Over DeFi Developers

The National Sheriffs’ Association had opposed the bill since May, arguing that Section 604 would give mixers, tumblers, and DeFi platforms a blanket pass from anti-money-laundering rules. Sheriff Troy Wellman, the association’s president, and Executive Director Justin Smith sent Senate leaders a letter dated September 3 that walked that opposition back to neutral.

Given the complexity of the legislation and the number of important details that remain under consideration, the NSA is changing its position on the CLARITY Act to neutral.

They wrote that the right move was to step back and let the process build a clear rule set. Major County Sheriffs of America had already gone neutral in July. That pairing removes a law-enforcement talking point Democrats such as Catherine Cortez Masto had used. It does not supply the seven floor votes, because the ethics demand is still on the table and the two committee Democrats never promised a blank check.

A 24/7 Equity Book Is Already Running on Deribit

While VanGrack was making the onshore case, Coinbase’s Deribit unit was already quoting stock and commodity perpetual contracts, margined in USDC, that trade through nights and weekends. The international derivatives book was scheduled to finish moving onto Deribit’s matching engine on September 9. Those contracts do not require owning the share. They are a second, leveraged way to sit in US equity risk on Coinbase rails without waiting on Senate text.

That split is the second-order fact under the interview. Tokenized stocks on Base are a claim on real shares held at Alpaca. Deribit perps are a price bet. Both run for non-US users under foreign licenses. Both keep running if cloture fails. Coinbase’s Washington posture has shifted with them: VanGrack holds the government-relations seat, and the company is no longer only defending old SEC cases. Executives were already in the room for a White House crypto session as CFTC advisers in August.

Lummis Puts the Next Opening in 2030

Senator Cynthia Lummis, the Wyoming Republican who has shepherded the Senate text, used September 8 to repeat the leadership warning. She pointed back to the 15-9 committee vote and said time is running out to keep the industry under US rules and on US soil.

She has also said that if this Congress misses, the next real opening is 2030. That date, not a rival regulator’s press release, is the clock she is selling. Replies under that post spent less time on China and more time on who profits from the ethics sunset and from stablecoin rewards. The product Coinbase already shipped does not wait on either argument. NVDAc and AAPLc keep minting under ADGM documents, Chainlink keeps publishing the total-return feed, and Deribit keeps showing a USDC mark on equity perps after the New York close.

If cloture fails on September 15, those venues do not unwind. If it passes, the Senate still has to debate, amend, and send a different text back to the House, and US wallets still cannot hold the Base stocks under the current prospectuses. VanGrack is right that tokenization is not a future tense. The September 15 roll call is about which statute, if any, the United States puts on top of a market that has already chosen Abu Dhabi.
